France recognizes new Syria opposition, U.S. restrained

BEIRUT (Reuters) - France became the first Western power to recognize a fledgling Syrian opposition coalition fully, stepping out beyond the United States, which said on Wednesday the body must first show its clout inside Syria.

Six Gulf Arab states recognized the Syrian National Coalition for Opposition and Revolutionary Forces on Monday and France followed suit the next day, unlike its European partners.

President Francois Hollande's decisive posture on Syria recalled that of his predecessor Nicolas Sarkozy on Libya last year, when France led calls for NATO action to protect civilians which effectively helped Libyan rebels topple Muammar Gaddafi.

The European Union bans arms sales to Syria, but Hollande said the question of arming rebels would be examined when the coalition formed a transitional government. Paris had previously ruled this out, fearing arms could reach Islamist militants.

U.S. Secretary of State Hillary Clinton said the formation of the coalition, which supersedes the widely discredited Syrian National Council as the face of the Syrian opposition, was an important step, but did not offer it full recognition or arms.

"We have long called for this kind of organization. We want to see that momentum maintained," Clinton told reporters in the Australian city of Perth. "As the Syrian opposition takes these steps and demonstrates its effectiveness in advancing the cause of a unified, democratic, pluralistic Syria, we will be prepared to work with them to deliver assistance to the Syrian people."

Suhair al-Atassi, a vice president of the new coalition, said that once it had proved it represents "revolutionary forces" on the ground, there would be no excuse for Western powers not to provide some form of military backing.

"The ball now is in the international community's court," she told Reuters in an interview in Dubai, blaming Western reticence to arm the rebels for the rise of extremism in Syria.

"There is no more excuse to say we are waiting to see how efficient this new body is. They used to put the opposition to the test. Now we put them to the test," she declared.

AIR STRIKE NEAR TURKEY

Syrian insurgents have few weapons against Assad's air force and artillery, which can pound rebel-held territory at will.

A Syrian warplane bombed the town of Ras al-Ain near the Turkish border again on Wednesday, rocking buildings on the frontier and sending up huge plumes of smoke, in the latest of several attacks since rebels captured the town last week.

After 20 months of a conflict that has killed more than 38,000 people, fragmented Syrian opposition groups struck a deal in Qatar on Sunday to form a coalition led by Damascus preacher Mouaz Alkhatib, who has appealed for international recognition.

Arab League and EU foreign ministers meeting in Cairo on Tuesday welcomed the coalition's formation as an important step, but did not recognize it as Syria's sole authority.

France, however, went ahead on its own. Hollande told a news conference in the French capital that Paris recognized the new Syrian national coalition "as the sole legitimate representative of the Syrian people and as future government of a democratic Syria making it possible to bring an end to Bashar al-Assad's regime".

Clinton announced an extra $30 million in aid to those affected by the war in Syria, to be delivered via the United Nations' World Food Programme, which is supplying food to more than a million people in Syria and to 408,000 Syrian refugees.

The United States says it is providing only humanitarian aid and non-lethal assistance to Assad's opponents, it acknowledges that some of its allies are arming rebels - something which Russia says shows Western powers want to decide Syria's future.

Russia and China have blocked any U.N. Security Council action on Syria, prompting Washington and its allies to say they could move beyond U.N. structures for their next steps.

So far, concerted action on Syria has been thwarted by divisions within the opposition, as well as by big power rivalries and a regional divide between Sunni Muslim foes of Assad and his Shi'ite allies in Iran and Lebanon.

An Iranian revolutionary guard general blamed Western, Turkish and Arab meddling for the bloodshed in Syria.

"They must leave the government and people of Syria alone so they can take the necessary decision about the kind of government in Syria," Brigadier-General Massoud Jazayeri was quoted as saying by the semi-official Fars news agency.

China also said Syrians should determine their own future.

"A political transition process guided by the Syrian people should be initiated and pushed forward as soon as possible, to realize an appropriate peaceful and just resolution," Foreign Ministry spokesman Hong Lei said.

A $199 laptop?that runs Google's Chrome OS was?introduced Monday by Acer, making it the same price as several tablets, such as Google's own Nexus 7 and Amazon's Kindle Fire HD. The Acer C7?laptop has an 11.6-inch screen. It goes on sale Tuesday, available from the Google Play store, at Best Buy stores and on BestBuy.com.

As with another recently announced Chromebook, from Samsung for $249, it's probably more of a second or third computer. If you're a heavy user of programs like Gmail and Google Docs, and primarily want a computer for Web browsing, the Chromebooks could do the trick.?

Among the chief differences between Samsung's and Acer's Chromebooks, aside from price, are weight and battery life.?The Samsung Chromebook weighs 2.4 pounds and has a battery life of 6.5 hours. The Acer C7 Chromebook?weighs 3 pounds and has a battery life of 3.5 hours.

It has an?Intel Celeron 847 processor, 2GB of?memory and a 320GB HDD for storing files.?It comes with three USB 2.0 ports, an HDMI port for video; a card reader that supports SD and MMC cards.

It Costs Apple At Least $188 To Build The iPad Mini (AAPL)

When Apple first announced the iPad mini last month, many were upset about the higher than expected price.

The miniature tablet's cheapest version retails for $329. But when compared to similar devices from competitors Amazon and Google, it seems as if Apple customers are paying a premium.

Today we discovered that there may be a reason for the higher price.

AllThingsD reports that it costs Apple $188 to manufacture the device.

Here's what?Arik Hesseldahl had to say:

The base model, a Wi-Fi-only 16 gigabyte iPad mini, which sells for a starting retail price of $329, costs about $188 to build. Adding additional memory ? the options are 32GB and 64GB ? adds only incremental cost but a fair amount of profit, amounting to an additional $90 for the 32GB version and $162 per unit on the 64GB model.

Besides revealing how much each individual part costs Apple, a teardown of the mini showed that the display is a new type of technology called GF2 made by LG. GF2 helps the overall display to be thinner than on previous generations.?

This new screen is also driving the price for Apple up.

He went to center court before the game to thank fans for coming to Madison Square Garden, when even the Knicks themselves didn't know if people were ready for sports yet.

Then he and his teammates provided a win for their city they know has lost so much.

Anthony had 30 points and 10 rebounds, and the Knicks gave suffering New Yorkers something to cheer with a 104-84 victory over the Miami Heat in their storm-delayed season opener Friday night.

"Over the last couple of days, we didn't even know if this game was going to be played. Then before the game we look up and they say they canceled the Marathon, so it was like, we have to go out there and play," Anthony said. "So today was something to give New York a couple hours of some peace. Come to the game, support us. We gave them a good show out there tonight, that's the least that we can do."

In the first sporting event in New York since Superstorm Sandy, the Knicks dominated a game the Heat players weren't sure should even be played with the region still so devastated. But the Knicks hoped they could provide a distraction for a few hours, and fans who were able to watch surely loved what they saw from a team that could barely compete with Miami last season.

Anthony noticed plenty of empty seats when he first came out to warm up, then saw they had almost all been taken by the time players returned for the opening tip.

"I think this win meant a lot for us, for the city, fans, you know, just everybody in New York," guard Raymond Felton said. "This was a big win, so I'm happy we got it."

Steve Novak, a non-factor against the Heat in last season's playoffs, added 17 points off the bench and Felton had 14 points and nine assists to begin his second stint with the Knicks.

LeBron James scored 23 points for the Heat, so impressive in a season-opening victory over Boston on Tuesday but never really in this one. Dwyane Wade, who thought the game should be postponed, finished with 15 points and Chris Bosh had 12 points and 11 rebounds.

The Heat beat the Knicks in five games in last season's first round, and at least for one night New York appears to have closed the gap on the champs.

But the focus surrounding this one had little to do with basketball.

Knicks players said Thursday they weren't sure what kind of crowd to expect with many New Yorkers in such bad shape and perhaps unable to travel to the game with the city's transit system crippled. But Madison Square Garden was packed with a sold-out crowd of 19,033 and lively from well before the tip right through their loud cheers when Rasheed Wallace, retired the last two seasons, entered with about 3 minutes left.

"Right from the get-go you could tell there was a difference in energy, disposition, quickness to the ball (on) both ends of the court," Heat coach Erik Spoelstra said. "They played a very good basketball game. Got us on our heels pretty much the whole game and we weren't able to recover from there. We have to move on. We're clearly much better than this."

Anthony took the microphone before the game and told fans that this was the "most important time for the city of New York to come together as one and build the city back up." Then there was a moment of silence for the victims of the disaster.

It wasn't long before it was loud again.

Anthony hit two 3-pointers in a 10-0 run that gave New York a quick 11-point lead, and he followed six consecutive points by JR Smith by pulling up for a long 3-pointer and a 30-12 lead with 1:14 left in the first quarter. Anthony was even further away when he tossed in another 3 at the buzzer, capping his 16-point period and giving the Knicks a 33-17 advantage.

The Heat couldn't get the deficit into single digits in the second, but were within 55-44 at halftime following 13 points from Wade after his scoreless first period. Anthony was 1 of 9 in the second after hitting six of 10 shots in the first.

But he had consecutive baskets in the Knicks' run of seven straight points early in the third, and the lead grew to 75-52 on Novak's 3-pointer with 3:12 remaining in the period. New York was ahead 81-63 heading into the fourth.

The Knicks' scheduled opener at Brooklyn on Thursday night was postponed, and Heat players thought this game would be, too. Wade was so sure the Heat weren't coming to New York that he didn't even bother to pack until after practice Thursday.

Miami flew afterward and finally arrived in New York after a three-hour bus ride from nearby Newark, N.J. Seeing all the traffic as New Yorkers tried to recover, Wade wrote on his Twitter account that the game shouldn't be played, a feeling he reiterated Friday morning after the Heat's shootaround.

"If we're in a car and we're in traffic for three hours, what are other people who are really affected by this, what are they doing? How are they getting around, how are they moving, et cetera?" Wade said. "So it was just like, come on man, we shouldn't be here to play a basketball game. If anything, we should be here to do something to help the city."

He decided Friday to donate his game check, around $210,000 before taxes, to relief efforts.

The Knicks finished 19 of 36 from 3-point range. Wallace made one with 41 seconds left.

Notes: The Madison Square Garden company is donating $500,000 for storm relief and is hosting a telethon on MSG network during the Knicks' game against Dallas on Nov. 9. MSG chairman James Dolan said he was glad Friday's game was taking place, believing it was good for the city and that many people had told him they were either coming or planned to watch on TV. ... The Heat announced Friday they will unveil a banner to commemorate James' gold medal with the U.S. basketball team Saturday before they play the Denver Nuggets. It will be displayed alongside three others for players who won Olympic gold as members of the Heat ? Wade, Alonzo Mourning and Tim Hardaway. ... Marcus Camby sat out after missing most of the preseason with a sore left calf. Border agents in fatal shooting had radio contact

PHOENIX (AP) ? Three U.S. Border Patrol agents responding to an alarm from an underground sensor were apparently in radio contact as they approached from opposite directions before opening fire on each other in the Arizona desert, leaving one agent dead, according to a sheriff's report released Friday.

It was a clear night and the agents were on patrol separately when the call came in at about 1:30 a.m. Oct. 2 that the sensor aimed at detecting smugglers and illegal immigrants had been tripped.

Agent Nicholas Ivie, 30, approached on foot from the north. The two other agents walked in from the south when Ivie apparently opened fire, eliciting a deadly barrage of return fire from his colleagues.

Ivie was killed. Another agent was wounded. The third wasn't injured.

Questions had swirled as to whether the agents were in radio contact with each other in the rugged, hilly terrain where signals can be spotty. A communication breakdown could have led to the confusion and ensuing shootout.

However, according to the preliminary report released Friday by the Cochise County sheriff's office, which is investigating the case along with the FBI, the uninjured agent later told authorities "they were in radio communication with Agent Ivie."

"At one point she observed (Ivie) signaling them with his flashlight," according to the report.

The agent, whose name hasn't been released, told investigators "as they were walking up the trail she heard yelling and then observed muzzle flashes in front of her and heard gunfire."

"She drew her weapon and took cover," the report states.

The agent also said she thought she saw several people moving through the darkness and whispering after the shooting.

The FBI declined to comment on the report, citing its own ongoing investigation.

Authorities have said the agents were about 20 yards from each other when the gunfire erupted. Acting Cochise County Sheriff Rod Rothrock has characterized the shooting as accidental, adding he didn't expect any criminal charges to be filed.

The FBI has called it a case of friendly fire but has declined to comment on any other aspects of the investigation.

One sheriff's deputy noted in the report that authorities initially believed it was a "possible ambush."

In the immediate aftermath of the shooting, FBI agents flew in on a Black Hawk helicopter, and heavily armed law enforcement officers secured the area, flooding it with personnel looking for potential assailants. Two people were detained in Mexico but were later released after they were found to have no connection to the shooting.

The report from the sheriff's office details the painstaking efforts to document the scene, collecting bullet casings, tracking unidentified footprints and following a blood trail. It mentioned six spent rifle casings clustered in the area, and that the only items not found holstered in Ivie's belt were his flashlight and pistol.

"His radio was still on/operating," the report stated.

While the report sheds some light on the shooting, key details remained unanswered, such as just why Ivie opened fire contrary to training that dictates agents should only discharge their weapons once they have identified a suspect as hostile.

"None of them should have started firing unless they were returning fire from a smuggler or whatever the perpetrator might have been," said retired Border Patrol Agent Jim Dorcy.

While it's clear something went terribly wrong, no one is publicly questioning Ivie's competency or his training. He's been described by fellow agents as an experienced law enforcement officer with six years at the Border Patrol, the kind of agent others looked up to.

U.S. Rep. Silvestre Reyes, D-Texas, a former Border Patrol sector chief in El Paso, said agents are trained for every potential scenario, but he noted "things often go contrary to plan," especially in a nighttime situation "in an area you know you might encounter bad guys."

"Your heart is racing. You're trying to identify who is where. Ideally, you're in communication with other agents, but it's not a finite situation where everything always works out," Reyes said. "That said, the job is dangerous enough when you're up against the bad guys, so you want to make sure you avoid any kind confrontation among what is commonly referred to as 'friendlies,' but we just don't know what happened out there yet."

Campaigns lawyered up for election overtime chance

MIAMI (AP) ? Legions of lawyers are ready to enter the fray in case Election Day turns on a legal challenge. One nightmare scenario would be for the results in a battleground state like Florida or Ohio to be too close to call, with thousands of absentee or provisional ballots yet to be counted.

The key, experts say, is whether the difference in votes between the two candidates is within what's known as the "margin of litigation" ? that is, the number of outstanding votes must be much greater than the margin separating Obama and Romney when the smoke clears. And, it must be in a state that's decisive.

"You'd have to have a state whose Electoral College votes are absolutely pivotal or there would have to be a massive problem involving voters," said Richard Hasen, law professor at the University of California, Irvine, and founding editor of the Election Law Journal. "There not only have to be problems in an election. They have to be widespread enough or the margin close enough that litigating would actually make a difference."

Legal and campaign officials on both sides say lawyers are poised at both the national level and in the key states to respond immediately if a court challenge is needed. The political parties have gained a lot of experience in legal fights over U.S. Senate and House seats. The last major legal battle over the presidency was the 2000 race, settled by the U.S. Supreme Court favoring George W. Bush over Al Gore.

On the Republican side, Washington attorney Benjamin Ginsberg leads the team. Ginsberg was deeply involved in the 2000 court fight as national counsel to the Bush campaign. Ginsberg is assisted by Kathryn Biber, the Romney campaign's general counsel, and Lee Rudofsky, who is the campaign's Election Day operations director.

Calling the shots for the Democrats is Robert Bauer, another well-known Washington lawyer, who is a former Obama White House counsel and Democratic National Committee attorney. Bauer oversees hundreds of lawyers who have volunteered to set up shop in "boiler room" operations in battleground states and across the country.

Both sides will have local attorneys on the team as well.

The Obama campaign also has built up a computerized system to track Election Day incidents in real time. Democratic poll monitors and operatives can call in incidents as they occur and the computer-based system will quickly give campaign officials in Chicago the ability to track and compare the reports and respond quickly.

"No one's going to be flat-footed here, or for that matter anyplace else," said Stephen Hunter Johnson, general counsel to the Miami-Dade County Democratic Party. "Whatever the challenges are, we're up and ready."

Lawyers will observe at targeted polling places, joined by tea party activists and voting abuse critics on the Republican side and civil rights and union groups on the Democratic side. And in crucial battleground states such as Ohio, Florida, Wisconsin and Virginia, Republicans have added legal and political muscle from governors, secretaries of state and GOP-dominated legislatures.

Some legal skirmishes have already begun. Bauer, for instance, wrote this week to Wisconsin's secretary of state raising questions about reports that some Romney poll watchers were being trained with information that could mislead or intimidate voters. State officials said they did not find evidence of egregious transgressions, but the issue could resurface in a potential postelection legal fight.

Election law experts say it's most likely that litigation over the presidency would come down to Florida or Ohio and probably involve either absentee ballots or provisional votes, meaning those that must be verified later by local election officials for a variety of reasons, such as a voter showing up at the wrong precinct, not having proper identification or having their eligibility to vote called into question by a poll watcher.

Edward Foley, director of the election law program at Ohio State University, came up with a hypothetical scenario in which Romney leads Ohio by 10,000 votes the day after the election ? but there are 150,000 outstanding provisional ballots that must be examined. Ohio law gives voters 10 days, until Nov. 17, to provide officials with any information needed to show they are eligible to vote.

Under this scenario, if Obama were trailing, Foley said the president's legal team would try to "rescue" as many provisional ballots as possible and likely would head to court to obtain lists of voters' names they could contact. A similar fight took place in Washington state in a 2004 Senate race, he noted.

"It would not surprise me if there emerged a legal tussle over the availability of this information," Foley wrote in a recent article on the scenario.

That would mean Americans might not know the identity of their next president until well into November.

The provisional votes also could come up in Florida, the other big battleground state. University of Florida political science professor Daniel Smith noted than in the August primary about 22 percent of all provisional ballots were rejected by local canvassing boards. That too could become a source of court battles over the validity of such rejections, if the initial outcome in Florida is close enough.

"There's no question we're going to have a boatload of provisional ballots as well as overseas ballots that are not going to be tabulated until after Nov. 6," Smith said.

Sometimes evidence of election problems doesn't lead to litigation, even though it could. In 2004, Democratic nominee John Kerry initially refused to concede because of issues with provisional ballots and other problems in Ohio. But the day after the election, when Bush's lead in the state swelled to about 100,000 votes, it was clear a court fight wouldn't matter and the Democratic lawyers backed off.

It's all about the margin, said Johnson of the Miami-Dade Democrats, who said:

"Litigation can be expected unless there's a clear outcome on Election Day."

Iraq court hands Sunni VP 2nd death sentence

BAGHDAD (AP) ? An Iraqi court has convicted the country's Sunni vice president on charges of instigating bodyguards to assassinate a senior government official and sentenced him to death.

Thursday's verdict was the second death sentence for Tariq al-Hashemi in less than two months, both delivered in absentia since he is in exile in Turkey. Al-Hashemi fled Iraq in December 2011, when the Shiite led-government accused him of playing a role in numerous attacks

He has denied the charges.

The criminal court in Baghdad also sentenced al-Hashemi's son-in-law to death on the same charges.

Supreme Judicial Council spokesman Abdul-Sattar Bayrkdar says the two suspects instigated bodyguards to kill an official by sticking a bomb to his car.

Al-Hashemi's attorney Muayad Obeid al-Ezzi says he was not informed about the hearing or verdict.
